The Adega Cooperativa de Borba, CRL is a wine bottling producer in the Alentejo region, which was founded in 1955 and brings together about 270 associated wine growers who cultivate 2,200 hectares of vineyards in the sub-region of Borba (70% red grape varieties and 30% white grape varieties), and which produces 1 million 9-litre boxes annually, and is one of the ten largest national producers in the sector.

These Terms and Conditions of sale are agreed between ADEGA COOPERATIVA DE BORBA, CRL, with head office at LARGO GAGO COUTINHO E SACADURA CABRAL 25, APARTADO 20, 7151-913 BORBA, PORTUGAL, Tax identification number 500 008 337, contact telephone number +351 268 891 660 and email geral@adegaborba.pt, hereinafter referred to as the “Adega de Borba” and the persons wishing to make purchases through the website www.adegaborba.pt, hereinafter referred to as the “User”.

The parties agree that purchases made through the website www.adegaborba.pt shall be governed exclusively by the present contract to the exclusion of any conditions previously available on the website.

 

Access to and use of the website and the online shop

When accessing the Adega de Borba online shop, customers are implicitly declaring they are over 18 years of age and do not have any impediment and/or legal restriction that prevents them from purchasing alcoholic beverages.

The Adega de Borba reserves the right to withdraw access to the online shop if it discovers that the user does not comply with such legal requirements.

 

Privacy and protection of personal data

Privacy

The right to privacy of Users/Customers is a concern of Adega de Borba and therefore the respect for the privacy rights of all visitors to this website is guaranteed.

Users may browse the Adega de Borba online shop anonymously, without providing any personal information. A visit to the Website, by itself, does not imply the automatic registration of any personal data that identifies the User/Customer.

However, the Adega de Borba may:

1. Collect information about behavior on the Website, other than personal information, in order to improve the navigability of the Website (in accordance with the regulated Cookie Policy).
2. Request the provision of personal data from Users/Customers in order for them to use certain content, features or services of the Website (under the terms of this Clause).

Responsibility for data processing

In compliance with Law 67/98 of 26 October, as amended by Law 103/2015 of 24 August, on the Protection of Personal Data, we would inform you that the processing of personal data collected on the Website is the responsibility of the Adega de Borba.

Data collection and processing

In order to access and use certain features of the Website, particularly ordering products online, the User/Customer must first register, by creating a personal account, which implies that some personal data is made available.

The personal data collected will be processed and stored on computers by the Adega de Borba, or by external entities subcontracted by it, to provide its services and is intended to manage the registration of Users / Customers on the Website and the use of features at the Online Store, including the processing of orders from Users / Customers and the delivery of products requested by them. For order delivery purposes, we hereby inform you that your contact details and address will be passed on to the companies hired by Adega de Borba to carry out the services contracted by its customers. The data will also be processed in communicating with Users/Customers, particularly to respond to requests for information and clarification, complaints, as well as comments or suggestions presented by Users/Customers. The data will also be used for statistical analysis and for direct marketing purposes and to promote Adega de Borba services through newsletters, for example.

Thus, depending on the features or service required by the User / Customer, the following personal data may be collected: name, tax identification number, address, postcode, location, telephone number, and email, as well as data on an alternative delivery address. Additionally, the Adega de Borba will have access to your purchase history and may, if necessary to confirm the payment of your order or resolve any issues arising therefrom, access data relating to financial transactions, provided to Easypay and SIBS. The allocation and use of a password when registering at the Adega Cooperativa de Borba online shop aims to preserve the security of your personal data. This password should not be shared with third parties. If you choose to share your password with a third party you assume all responsibility for any damages that may arise from such sharing.
Unregistered Users/Customers may browse freely through the Website and view the products available for order, as well as other content made available by the Adega de Borba, and may place orders, in which case additional information will be requested such as name, tax identification number, address, postcode, location, telephone number, and email, as well as information concerning an alternative delivery address. They may subscribe to the Adega de Borba newsletter, in which case they will be asked for their name and email address. You can also request an appointment to visit the Adega de Borba, in which case you will be asked to provide your name, email, and telephone number.

The Adega de Borba assumes that the data collected has been inserted by the respective owner and/or that such insertion has been authorized by the same, with this being true, current, and accurate.
The Customer expressly authorizes the Adega de Borba to send information on products and services that may be of interest to him/her, using his/her personal data for direct marketing purposes through any communication channel, particularly through the use of email, SMS, MMS or other forms of automatic call.

Right of access

Adega de Borba does not sell, exchange or transfer to third parties the personal information of Users/Customers.

Notwithstanding the above, the personal information of Users/Customers may be transferred to external entities subcontracted to provide certain services (delivery of orders).

Under the terms foreseen in the law, the User/Customer is guaranteed, at all times, the right to access, rectify and delete their personal data, as well as the right to oppose its processing, except in cases foreseen in the law or if its storage is necessary for legal purposes. Security measures

Adega de Borba guarantees the confidentiality and security of data provided by Website Users/Customers.

Adega de Borba uses its best efforts to protect the personal data of Users/Customers against unauthorized access through the Internet. To this end, it uses security systems, rules, and other procedures in order to guarantee the protection of the personal data of Users/Customers, as well as to prevent unauthorized access to data, its improper use, disclosure, loss, or destruction.

Purchasing process

The purchase of wines from the Adega de Borba through the online shop is only available in Portuguese, but it is possible to consult and request information about the wines in English directly on the site.

Availability of stocks

Items for sale in the online shop are subject to existing stock and orders will be processed on a first-come, first-served basis.

In the event of being temporarily or permanently out of stock, the customer will be duly warned and suggested an alternative product with similar characteristics.

Prices of items

The prices of products are indicated in euros (€) and include VAT at the legal rate in force.

Purchase

The Adega de Borba online shop has the following payment alternatives available to its customers:

  • Bank transfer;
  • Payment by ATM;
  • Payment by credit card (Visa, Mastercard, American Express).

In the case of payment by credit card, this is done securely on the Easypay partner site.

Order confirmation email

After completing the purchase, the customer will receive an email confirming receipt of the order. In this email, the customer will also receive the necessary data to make the payment, according to the chosen method. Once the order is paid, you will receive a new email indicating this.

Order status

Each order has an associated status, which varies according to the point in the purchasing process.

  • Awaiting Payment.: The order was successfully placed; however, the payment has not yet been processed.
  • Underway: The order was successfully placed, and payment has been processed.
  • Completed: The order has been dispatched or delivered.
  • Canceled: The order has been registered, but canceled before the payment has been made, therefore the order will not be processed.
  • Refund: The order has been registered but returned after payment has been made.
  • Refused: The credit card used to pay for the order has not been authorized, therefore the order will not be processed.

Transportation conditions

The Adega de Borba has packaging suitable for the transport of goods, produced in such a way as to effectively protect its contents.

Adega de Borba products are shipped through Torrestir and deliveries are available throughout mainland Portugal and the Portuguese Islands.

Delivery times

Depending on whether the delivery address is located in mainland Portugal or on the islands, the following delivery times are expected:

The Adega de Borba does not guarantee these delivery schedules during periods involving promotions, Christmas, or being out of stock.

Deliveries are made between 9 am and 6 pm Monday to Friday.

Deliveries between 6 pm and 9 pm (Monday to Friday): 50% surcharge on listed prices.

Saturday deliveries between 9 am and 1 pm: add € 25.00 to listed prices.

If the customer is not available to receive the order, the carrier will contact the customer to schedule a new delivery.

Delivery Charge

The delivery charge varies according to the weight of the goods, as indicated in the following table:

The values indicated include fuel tax (3%), SCUTS surcharge (2.1%) and VAT (at the legal rate in force).

Damaged products

The Adega de Borba is responsible for the delivery of the products in good condition and is available to attend to any complaints.

In the event of orders not being delivered as required, the customer should inform the carrier and send an email to Adega de Borba at geral@adegaborba.pt specifying the subject matter, so that the situation can be rectified as soon as possible.

The Adega de Borba will analyze the non-conformity of the products and reserves the right to accept the claim, or not, according to the results of the analysis.

In situations of non-compliance, the Adega de Borba is committed to providing credit to the customer equal to the value of the product, which can be used to purchase any other product available in the online shop.

Cancelations and returns

Should the customer wish to cancel or return the order, he or she must immediately contact the Adega de Borba at geral@adegaborba.pt specifying the subject matter and the reason for the cancellation or return.
In the event of cancellation, the customer has until 24 hours after the payment is made to request the cancellation of the order (after this period the order may have already been shipped, so it will be treated as a return)

In the event of returns, the customer will receive an email with information on the procedures to carry out to make the return, which must be made within 14 days after receiving the order.

The Adega de Borba reserves the right to only accept returns of products that are in proper condition.

According to Art. 4 of DL143/2001, the consumer has the right to free termination under the following terms:

In distance contracts, the consumer has a minimum period of 14 days from the receipt of the goods to rescind the contract, without paying any compensation and without the need to state a reason, by sending a registered letter with acknowledgment of receipt communicating this intent. The price of the goods will be refunded to the consumer, within a maximum of 30 days, less the cost of returning the goods. The goods must be returned in good condition (including original packaging).
